4. Service Engagement
A professional engagement with Tidewall Advisory begins when both parties have agreed in writing to the scope, deliverables, timeline, and fees for the relevant service. An engagement letter or written confirmation by email constitutes a binding agreement.
Our three current service offerings are:
- 01Process Observation Study — A written observation report with diagrams of a process as it currently operates. MYR 3,280.
- 02Process Refinement Advisory — Tailored advisory support for teams considering measured process adjustments. MYR 2,560.
- 03Process Review Session — A structured two-and-a-half hour session with a written summary. MYR 660.
Service descriptions on this website are provided for informational purposes and do not constitute a contractual offer. The precise scope of each engagement is agreed in writing prior to commencement.
5. Fees & Payment
Unless otherwise agreed in writing, the following payment terms apply to all engagements:
- A deposit of fifty percent (50%) of the agreed fee is due upon signing of the engagement letter
- The remaining balance is due within fourteen (14) days of delivery of the final deliverable
- For single-session engagements, full payment is due prior to the session date
All fees are quoted and payable in Malaysian Ringgit (MYR). Invoices are issued by Tidewall Advisory and must be settled by bank transfer unless an alternative arrangement has been agreed.
Overdue payments may attract a late payment charge of 1.5% per month on the outstanding balance, applied from the due date.
6. Cancellation & Rescheduling
We understand that circumstances change. If you need to cancel or reschedule an engagement, please notify us in writing as soon as reasonably possible.
- More than 10 business days before commencement: No cancellation fee. Any deposit paid will be refunded in full.
- 5–10 business days before commencement: 25% of the agreed fee is retained to cover preparation costs incurred.
- Fewer than 5 business days before commencement: 50% of the agreed fee is retained.
- After commencement: Fees for work completed to date are non-refundable. Outstanding fees for incomplete work will be assessed proportionately.
Rescheduling of single sessions is offered once without charge, provided at least 48 hours' notice is given.
7. Intellectual Property
All content on this website — including text, diagrams, layouts, and branding — is the intellectual property of Tidewall Advisory and is protected under applicable Malaysian and international copyright law. You may not reproduce, distribute, or adapt any part of it without prior written permission.
Deliverables produced in the course of an engagement — such as observation reports, process diagrams, and written refinement notes — are made available to the client for their internal use upon full receipt of payment. Tidewall Advisory retains the right to use anonymised and aggregated insights from engagements for the purposes of internal development and methodology improvement, unless otherwise agreed in writing.
8. Confidentiality
Tidewall Advisory treats all information shared by clients in the course of an engagement as confidential. We do not disclose client information to third parties except where required by law or where explicit written consent has been provided.
Where a formal Non-Disclosure Agreement (NDA) is requested, we are pleased to review and sign a mutually acceptable document prior to commencement. Our standard practice already reflects a high standard of confidentiality even without a formal NDA in place.
9. Limitation of Liability
Tidewall Advisory provides professional advisory services and delivers observations, recommendations, and written materials based on our direct observation and professional judgment. We do not warrant that any particular outcome will result from acting on our recommendations.
To the fullest extent permitted by Malaysian law, our total liability to any client for any claim arising from or in connection with an engagement shall not exceed the fees paid for that specific engagement. We shall not be liable for indirect, consequential, or speculative losses.
Nothing in these terms limits liability for fraud, gross negligence, or any matter that cannot be excluded by law.
10. Third-Party Links
This website may occasionally include links to external websites for reference purposes. Tidewall Advisory does not endorse, control, or take responsibility for the content, privacy practices, or accuracy of any third-party website. Visiting linked sites is at your own discretion and risk.
11. Modifications to These Terms
We may update these Terms and Conditions from time to time to reflect changes in our services, legal requirements, or operational practices. When we do, we will update the "Last updated" date at the top of this page.

These Terms and Conditions are governed by and construed in accordance with the laws of Malaysia. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.
We would always encourage clients to raise any concern with us directly first, as most matters can be resolved through straightforward conversation.
